Sell land in Washington with the facts in hand

Washington asks more of a land seller than most states: a statutory disclosure form for unimproved residential land, a graduated excise tax the seller pays, and a notice of continuance for current-use parcels. StraightAcre reviews parcels across the state, buys directly or assigns its contract with written notice, and closes through a licensed escrow or title company.

How StraightAcre operates in Washington

Washington is an active state for StraightAcre. We start with the county assessor’s record and the treasurer’s balance, then put terms in writing. The contract states whether we are buying for our own account or assigning our purchase contract to a vetted buyer, and you see that before you sign.

The state licensing chapter defines brokerage services as services rendered “to another, or on behalf of another for compensation,” and it does not apply to a person who buys or sells property for their own account. We buy for ourselves. Whether a later assignment is a service to another is a question we expect your attorney to raise, and the contract answers it. The Consumer Protection Act bars unfair or deceptive acts in trade. The distressed property law adds protections for a dwelling facing foreclosure, but bare land is not a dwelling, so our contract has to stand on its own terms.

Locate the parcel number and the county offices

Washington counties split the work. The assessor values and maps, the treasurer bills and forecloses, the auditor records deeds, and planning decides what a lot can hold. The five counties below have large rural and recreational land inventories.

  1. Find the parcel number on a tax statement or in the county parcel search.
  2. Confirm acreage, legal description, and any current-use or forest land designation in the assessor record.
  3. Ask the treasurer whether any year is delinquent and whether a certificate of delinquency has issued.
  4. Send us the parcel number and county. Many rural parcels have no situs address.

The assessed value is the county’s figure for taxation, and the classification code tells you whether the parcel is enrolled in open space, farm and agricultural, or designated forest land, which changes what a sale costs you. See our valuation guide.

Delinquency, the three-year certificate, and redemption

First-half taxes are due April 30 and the balance October 31, and each half is delinquent the day after. For taxes levied in 2023 or later, interest runs at nine percent a year on residential property of four or fewer units and twelve percent on everything else. Non-residential property also picks up a three percent penalty on June 1 and eight percent on December 1.

After three years of delinquency the county treasurer issues a certificate of delinquency and files a foreclosure action, after a title search and notice to the record owner and lienholders. Balances of $100 or less are left alone unless the parcel is a declared nuisance. You can redeem at any time before the close of business the day before the sale by paying the certificate amount, interest, later taxes, and costs, and no redemption fee may be charged. Once the parcel sells, there is no redemption. A minor or a legally incompetent owner has three years. Any sale proceeds above the amount owed are refunded to the person who held title when the certificate issued, on a claim filed with the treasurer within three years of the sale.

A sale to us can pay the certificate at closing, but the treasurer’s sale date does not wait for a contract. Ask the treasurer for the payoff in writing and read our back taxes guide before you commit.

Inherited land and who has authority

A personal representative with nonintervention powers may sell and convey estate real property without a court order and without notice to the court, as long as the sale is made in good faith. The small estate affidavit covers probate estates of $100,000 or less and speaks to personal property. It is not a route for land. Where no probate was opened, title companies in Washington often rely on a lack-of-probate affidavit, a community property agreement, or a transfer on death deed, but the insurer decides what it will accept for your parcel.

Escrow, deeds, excise tax, and recording

Escrow agents are licensed by the Department of Financial Institutions under the Escrow Agent Registration Act; attorneys, title insurers and their licensed agents, and brokers who take no escrow fee are exempt. Most land sales close through an escrow or title company. A statutory warranty deed conveys fee simple with covenants of seizin, freedom from encumbrances, and quiet possession; a bargain and sale deed promises less. A quitclaim deed promises nothing.

The state real estate excise tax is the seller’s obligation and is graduated: 1.1 percent on the portion of the price up to $551,000, 1.28 percent up to $1,551,000, 2.75 percent up to $3,051,000, and 3 percent above that, using the thresholds the Department of Revenue lists as effective January 1, 2027; sales that close before then use the lower 2023 table on the same page. Land classified as agricultural or timber land pays a flat 1.28 percent instead. Counties and cities add a local rate of at least 0.25 percent. The tax is paid to the county treasurer with an excise tax affidavit, and the auditor will not record the deed until the affidavit is stamped. Recording has formatting rules (a three-inch top margin on page one, among others), and the auditor sets the current fee.

No building, septic, or other development permit may issue for a lot that was divided in violation of the subdivision chapter, with an exception for an innocent purchaser without actual notice. A buyer will ask how the parcel was created. In the watersheds covered by the 2018 streamflow law, a new permit-exempt domestic well at the building permit stage carries a $500 fee and a 3,000 gallons per day annual average limit until watershed rules say otherwise. Water availability is a question for the county before anyone calls a parcel buildable.

Every county and city must adopt development regulations that protect critical areas, wetlands among them, and the Department of Ecology regulates wetlands under the Water Pollution Control Act and the Shoreline Management Act alongside the Army Corps of Engineers. The Shoreline Management Act covers marine waters, lakes of 20 acres or more, streams above 20 cubic feet per second, and shorelands 200 feet landward, where the local shoreline master program governs permits. If the parcel is classified as open space or farm and agricultural land, the classification is removed on sale unless the buyer signs a notice of continuance attached to the excise tax affidavit. Otherwise the seller owes the additional tax for the prior seven years (four years for farm and agricultural land removed on or after September 1, 2025), plus interest and a twenty percent penalty. The auditor cannot record until it is paid. Designated forest land works the same way with a compensating tax of up to nine years.

Washington also requires a seller disclosure statement for unimproved residential real property, meaning land zoned residential with no dwelling on it. The form covers title, water, sewer or septic, electrical and gas, flooding, soil stability, environmental conditions, and other facts, and must be delivered within five business days of mutual acceptance unless the buyer waived it in writing. The buyer then has three business days to rescind. The environmental section cannot be waived if any answer would be yes. Land zoned commercial or classified as timberland uses a different form, so ask which one applies.

Questions Washington land sellers ask

Do I have to fill out a seller disclosure statement for bare land in Washington?

Yes, if the land is zoned residential and has no dwelling on it, unless the buyer waives the statement in writing. The form must be delivered within five business days of mutual acceptance, and the buyer has three business days after delivery to rescind.

When does the county treasurer foreclose on unpaid taxes?

After three years of delinquency the treasurer issues a certificate of delinquency and files a foreclosure action. You can redeem until the close of business the day before the sale, and after the sale there is no redemption except for minors and legally incompetent owners.

Who pays the real estate excise tax?

The seller. The state rate is graduated from 1.1 percent on the first $551,000 of the price under the thresholds effective January 1, 2027, local rates of at least 0.25 percent are added, and classified agricultural or timber land pays a flat 1.28 percent.

My land is in the open space or farm program. What happens when I sell?

The classification is removed unless the buyer signs a notice of continuance on the excise tax affidavit. Without it the seller owes up to seven years of additional tax (four years for farm and agricultural land removed after September 1, 2025) plus interest and a twenty percent penalty before the deed can be recorded.

Can an executor sell inherited land without a court order?

A personal representative with nonintervention powers can sell and convey real property without a court order, acting in good faith. If no probate was opened, the title insurer decides whether a lack-of-probate affidavit, community property agreement, or transfer on death deed is enough.

Can a buyer drill a well on my parcel?

In watersheds covered by the 2018 streamflow law a new permit-exempt domestic well at building permit stage carries a $500 fee and a 3,000 gallons per day annual average limit until watershed rules set other terms. Ask the county about water availability before describing the land as buildable.

What our free review looks at in Washington

For a Washington parcel we pull the parcel number and owner of record, the assessed value and any current-use or forest land designation, the treasurer’s balance, FEMA flood data, visible recorded access and easements, and whether we would make an offer and on what structure. Daniel Michael Newland signs off on each one; it is a public-record summary, not an appraisal, survey, title opinion, or approval to build.

We buy directly or assign our purchase contract to a vetted buyer, and we tell you in writing which before you sign. In Illinois and Rhode Island we make direct purchases only, unless a licensed broker is involved. You receive your proceeds at closing through a licensed title or escrow company. Direct purchases use lender or transactional funding; any financing condition belongs in the purchase agreement. TechStack Consulting LLC, a Texas LLC, is the contracting entity.

Details of the parcel review are on its own page. The form below shows the current schedule.
